In January this year, third-party accessory makers were showing off a bunch of upcoming Switch 2 accessories at CES 2025. problem? No one officially saw Switch 2 in Wild. Despite many leaks, Nintendo didn’t announce the console until about a week after CES. Genki later made it clear that all of its designs were based on the leak specifications of Switch 2.
Over the weekend, GamePost reported that Nintendo sued the parent company of Jenki, human, alleging trademark infringement, unfair competition and false advertising. Nintendo claims that the accessories may have been misunderstood as an official partnership with Nintendo. In January, Nintendo had to issue a statement, clarifying, as reported by the Japanese division of CNET, “the gaming hardware that Genki presented as Nintendo hardware at CES was unofficial and not provided to us.”
Even after a tough response from Nintendo that denied the partnership, Jenki continued to increase its Switch 2 accessory plans.
In response to the lawsuit, Genki posted a statement to X, saying, “While we cannot comment in detail, we are continuing to prepare to meet our orders this week at Pax East and showcase our latest products.”
A new lawsuit from Nintendo reveals that there are limits to the company’s patience regarding third-party accessory makers riding the coattails of the console launch. In addition to destroying Genki’s Switch hardware, Nintendo also said that “we are seeking damages that are maintained as a result of defendant’s infringement, unfair competition and false advertising, and that we have received damages.” That sounds… expensive.
